Pending the issue of the definite bonus, a single bond for $7,400,000 wim issued by tilt? railway company, and guaranteed by the Provincial government. This was taken up at par by J. P. Morgan & Co., which later made a public isstiu of the h *>roce<>ds of the sale, $7,400,1100, were deposited in Edmonton banks, $6,000,000 In the Royal Bank, $1,-000,000 in the Union Uank, and $400,000 in the Dominion Bank. Construction work was begun, surveys pushed, and supplies purchased. In February, 1910, a fight over the ttjrms of the agreement with the railway company developed in the A'iterta legislature, and in May Prc- suecoeileu by Hon. A. L. Sifton, the present premier. Under Mr. SlCtoit'fl advice the legislature passed an act confiscating the whole of the proceeds of the bond sale, $7,400,000 and interest, to the general revenue fund of the province. The Dominion and Union banks paid the money hold by them into court, but the Royal bank refused to hon(,r the province's cheques, and was promptly sued. It made the railway company and construction company co-defendantB, and though beaten twice in the provincial courts, carried the suit to the privy council, where It won. * Briefly, the judgment of the privy council was that the conllscatory statute of Alberta was ultra vires. the money having been obtained for the construction of the railway and deposited in the banks to be paid out during the progress of construction only. The money then became the property of the bondholderu if the undertaking was not proceeded with and a provincial legislature had no power to affect the rights of thoRe who lived beyond the. province. A phase of the controversy which has not heretofore boen disclosed, injected an International feature. In June, 1911, \V. R. Clarke, the Kansas City banker, who promoted the railway and sold tlie bonds to the Morgans, made a formal complaint to the state department at Washington that the rights of Ajnerican citizens had been taken away from them without compensation.
