conviction VANCOUVER CP - She Ha Helen Beaupre 20 con vlcted of Indecency b being nude on a public beach had her conviction quashed Thurs Thursday ¬ day by a British Columbia Supreme Court judge who said she was charged under the wrong section of the Criminal Code Mrs Beaupre was fined 50 last September after the RCMP charged her with wll fully doing an Indecent act by exposing her private person b being nude In a public place In front of one or more persons Her lawer Don Rosen bloom told Mr Justice J G Could the woman should have been charged under Section 109 of the Criminal Code which sajs that everyone without lawful excuse who Is nude In a public place Is guilt of an offence Mr Justice Gould said that on examining the two sections one might fairly conclude that the Parliament of Canada thought the being nude was not always an Indecent act otherwise it would have not added the section 159 dealing specifically with nudity He was told that on Aug 11 last year Mrs Beaupre was on Towers Beach In the Unl verslty of B C area nude lying on her stomach reading The police officer scame spoke to her and she got up on the direction of police and exposed herself Mr Justice Gould said that the code had so rarely dealt with nudity in a public place that the phrase Indecent act denotes more greater moral turpitude He said the facts did not support the charge under Sec tion 158 and that it should have been laid under Section 119 SH Mining Is on the move in the sentral interior One company iware of its implications Is BC Tel which printed the following article In its staff wants to suspend the licence of Captain Robert James Pollock the man In charge of the ferry Queen of Victoria when she collided with a Russian freighter last sum mer Three persons died In the col Stewart conducted an lnqul j Into the collision be tween the two vessels and though he found Captain Pollock guilty of faulty seamanship which was Inexcusable he did not suspend his licence Judge Stewart did however suspend the licence of Captain David Gerald Crabbe a Cana dlan pilot on the Russian ship the Sergey Yesenln at the time of the accident The collision took place on Aug 2 In Active Pass a narrow stretch of water In the islands of the Georgia Strait The ferry loaded with passengers and cars was on her regular run be tween Vancouver and Victoria In his appeal to the Ex chequer Court the minister of transport contends that the deel slon of Judge Stewart not to suspend the licence of Captain Pollock is against the evidence and the weight of evidence present before the Inquiry Into the collision The appeal contends that the judge erred in deciding that the suspension of Captain Pollock by his employers was a suffl clent penalty and that he fur ther erred by holding that Cap tain Pollocks previous good character and seamanship Jus tilled not suspending his licence The appeal notes that slml lar previous good character and seamanship on the part of Captain Crabbe did not prevent the suspension of his licence as a pilot The transport ministers ap peal further argues that the wrongful acts of Captain Pol lock warrant suspension and that Judge Stewart did not give consideration to Section 647 of the Canada Shipping Act which states that failure to observe collision regulations constitutes wilful default SHELL CANADA LIMITED Has for Lease New 2 BAY SERVICE
