B.C. man loses fight to stay
  VANCOUVER (CPi — Frederick Nachbaur came to Canada as an infant, has lived in North America for the last 35 years and opened a computer software distribution company in the West Kootenay town of Nelson.
  But next month, he will be escorted to a plane and deported to West Germany. The Immigration Department considers him an illegal immigrant who deliberately abandoned Canada.
   “Sure I’m bitter,” Nachbaur said in a telephone interview Thursday, “not to the people of Canada, but about the way this has gone as far as government bureaucracy.”
   He wonders whether he is being used as a scapegoat.
  “Perhaps I was viewed as an easy target. ‘Oh. here’s a guy we can throw out. Oh look here, we’re really throwing people out.’” Nachbaur has exhausted all appeals and hopes public opinion and a direct appeal to Prime Minister Mulroney can prevent the de-
  Indians can catch sockeye
  VANCOUVER (CP) - Port Alberni Indians now have federal Fisheries Department permission to catch 10,000 sockeye salmon on the Stamp and So-mass rivers in spite of a department-ordered fishing closure on the two Vancouver Island rivers.
   Members of the Sheshaht and Opetchesaht bands, citing aboriginal rights, have been carry-ing.out their annual food fishery in spite of the closure.
   A 10-day truce, agreed to after a tense confrontation July 8. had lapsed with no agreement and fishing resumed Wednesday. The confrontation arose when fisheries officers seized a seine net and 150 salmon from a pickup truck.
  The fishing closure was ordered because fisheries officials fear not enough sockeye are returning to the rivers to spawn.
   Pat Chamut, the head of the western region of the federal Fisheries Department, said Thursday the concession to the 750 members of the two bands was made at least partly “to avoid someone being hurt.
   “Under the Constitution and the laws as they’ve been recently interpreted the Indians do have a right to fish for food purposes and it’s a right that gives them priority over other users.” he said.

 portation. But Al Thiessen, acting regional immigration manager, said Nachbaur’s case has received a full review.
   “We have a valid deportation order that the law allows us to execute.” he said. “At this time there haven’t been any plans to change."
   Nachbaur’s story is one of bad advice, blind faith and go-by-the-book immigration officers.
   Nachbaur emigrated to Canada in 1951 when he was 11 months old. His parents took out Canadian citizenship, but were apparently told their son would have to wait until he came of age. By that time he was in the United States.
   The family — Nachbaur has six younger brothers and sisters, all Canadian citizens — moved to the U.S. in 1964. His parents returned to Canada five years later, but he remained, completing high school and university, then working in California with an alien registration card that has since expired.
   He returned to Canada in 1984 af-
 ter his marriage broke up. partly because his wife did not want to leave the U.S. He applied for readmission. but after nearly a year of no contact, the Immigration Department told him it had not received his application.
   After a series of hearings, he was ordered deported Aug. 20. 1986. when it was ruled his 20-year stay in the U.S. meant he had abandoned Canada as a permanent place of residence.
   “That’s the issue we’ve been battling over.” Nachbaur said.
  Jim Downs, the lawyer who handled the appeal, said Nachbaur found himself in a Catch 22 situation. A section of the Immigration Act allows a permanent resident to appeal a deportation order on humanitarian grounds, but Nachbaur was ruled to have ceased being a permanent resident.
   Nachbaur can reapply to enter Canada once deported, but needs ministerial approval to overturn the deportation order, a process
 that could take several months. He said immigration officials have told him he should have no problem getting back into the country, but have refused to give any assurances in writing.
   Nauchbaur. who is not fluent in German, will likely stay with uncles in West Germany while his brother and sister-in-law run the mail-order distribution company.
   Downs said the case raises contradictions in Canadian immigration policy when a person whose family lives here, who runs his own business “and can clearly make a contribution" is deported while the illegal Asian immigrants who landed in Nova Scotia earlier this month are allowed to stay.
   Sharon Heslin, an alderman on Nelson city council, agrees.
   “He’s got his own business, all of his family is here — of course he's a Canadian.” Heslin said Thursday. “We should land him on the beach, then maybe he could stay.”
HAGEN LISTED AS MANAGER
Minister errs on disclosure
   VICTORIA (CP) - Filing a financial disclosure is turning into a comedy of legal errors for Advanced Education Minister Stan Hagen.
   The latest came Thursday when Hagen filed his financial disclosure form a week late and without the corrections he had promised to make Wednesday.
   The form, signed and dated July 22, listed Hagen as manager of Co-mox Valley Ready Mix Ltd. Hagen said Wednesday he hired a manager in November and at the same time instructed his lawyer to transfer control of the company to his wife, Judy.
   Hagen was told by a reporter Thursday that the mistake had been repeated.
  “I haven’t had anything to do with the management since November.” Hagen said.
   “I guess I’ll have to get hold of my lawyer again and tell him we’ll have to refile it. It’s incorrect. That’s just unbelievable.”
  Under Premier Bill Vander Zalm’s conflict-of-interest guidelines, “ministers shall not retain or hold directorships or other offices in any active financial or commercial corporation, other than a Crown corporation.”
   When Vander Zalm set the guidelines in January, he said ministers who broke them would be fired. He said Wednesday he had no intention of firing Hagen.
  The financial disclosure form wasn’t Hagen’s only problem. He
 had signed as president of the cement company on a form filed June 3 with the B.C. registrar of companies.
   “Those documents were to have been filed by her (Hagen’s wife Judy) as president," Hagen said Wednesday. “I guess it’s just one of those things that comes across your desk and you sign it."
  The cement company had a $50,000 contract with the University of British Columbia’s research farm in the area. Farm director Niels Holbek said Thursday Co-mox Valley Ready Mix Ltd. got the contract because its bid was considerably lower than the others.
   “As far as we’re concerned, it's all above board.” Holbek said.
