The Prince George Citizen - Saturday, April 14,1990 - 7 Local, provincial Rent bylaw upheld VANCOUVER (CP) — A city bylaw preventing landlords from selling long-term leases on rental apartments has been upheld by the B.C. Supreme Court. But long-term leases for 86 suites in a Kerrisdale apartment building are still valid because the bylaw isn’t retroactive, Justice Ronald Holmes ruled in a decision released this week. The suites were sold by the building’s owner to a sister company one day before the bylaw was passed last Oct. 17. The decision gives Fonent Properties Ltd. the right to sell 103-year leases for the 86 suites. “It appears we have the opportunity to go ahead (with sales) and we’ll consider that over the next few days,’’ said Ross Elliott, a director of Fontainebleu Holdings Ltd., Fonent’s sister company and the building’s owner. He said 29 suites in the building are vacant. No one has been evicted, he said, but suites were not rented out again when tenants moved out voluntarily. But Mayor Gordon Campbell said he expects city council will amend the bylaw at its April 24 meeting to prevent Fonent from selling any more leases to prospective buyers. To date, two such leases have been sold. “Council will do whatever it can do to close off the loophole,” he said. Fontainebleu Holdings sent letters to tenants last October offering the long-term leases for $250,000 to $500,000. They were told they would also have to pay maintenance fees and a portion of the building’s annual taxes. Holmes said he found “no evidence (the city) has been unfair, oppressive, patently unreasonable or arbitrary in its actions.” He also said the bylaw didn’t overstep the city’s authority to regulate businesses or infringe on matters in provincial jurisdiction. The decision was welcomed by Betty Tangye of Concerned Citizens for Affordable Housing, a Kerrisdale tenants’ rights group. “It certainly is good news,” she said. CORRECTIONS TO SEARS DAYS FLYER 1. The Cramers have lived in Prince George for 19 years, and two of their six children still live in town. They 60th anniversary have 22 grandchildren and 20 great-grandchildren.
