A6 THE FREE PRESS LAW OCTOBER 10, 1996 Kleinstueber’s Six months for drug trafficking appeal date set By CHERYL JAHN Free Press staff writer A man convicted of drunk driving in the death of a local teen in May 1995 will have his day in court. Again. The B.C. Court of Appeal will hear a bid from John Joseph Kleinstueber’s lawyers on January 28, 1997. At that hearing, his lawyers will attempt to have a February 7, 19%, ruling - in which Mr. Kleinstueber’s bid to change his plea was denied and he was sentenced on drunk driving charges - overturned by the Court of Appeal. Mr. Kleinstueber was convicted of hitting and killing 17-year-old Rory Salter with his van while trying to leave the parking lot of the 7-Eleven store on Queensway while under the influence. He was charged with impaired driving causing death, driving over the legal limit and dangerous driving causing death. Following the preliminary inquiry in August, he pleaded guilty to the charges, but claims he changed his mind shortly afterward. “It didn’t sit right, so three days later, I wanted to change my plea,” he claims. His bid to do so began in September, 1995. But in early February, Judge R.B. Macfar-lane denied Mr. Kleinstueber that option and, instead, sentenced him to serve two years less a day at the Prince George Regional Correctional Centre, three years on probation once the jail time was served and prohibited him from driving for seven years. In the Application for Leave to Appeal, filed this past March, lawyer Keith Aaitsen stated not only that Judge Macfarlane “erred in refusing to allow (Mr. Kleinstueber] to withdraw his plea of guilty,” but also that the sentence imposed in February “is excessive.” Mr. Aartsen is also asking the Appeal Court grant Mr. Kleinstueber leave to change his plea from guilty to not guilty, and if not, reduce the sentence imposed this past February. Assault Stanley Irvin Jack Cassel has been ordered to serve 12 months on probation and pay a $1,000 fine after pleading guilty to assault. Dulcy Diane Guay has been ordered to serve a six-month conditional discharge after pleading guilty to assault. Cory Lee Heer has been ordered to serve 30 days in jail, 18 months on probation and has been given a two-year weapons prohibition after pleading to assault. Clary Dolphus Poitras has been handed a nine-month suspended sentence after pleading guilty to assault, causing mischief to property under $5,000 in value and causing a disturbance in a public place. COURTREPORT Dangerous Driving Esa Markka Lehti has been ordered to pay a $1,200 fine and is prohibited from driving for six months after pleading guilty to driving without due care and attention. Drugs Brenda Marie Hillier has been ordered to serve six months in jail after pleading guilty to three counts of trafficking in a narcotic. Drank Driving Martin Joseph Sims has been ordered to pay a $1,200 fine and is prohibited from driving for six months after pleading guilty to impaired driving. Failure to Comply Joel Walter Thompson has been ordered to serve 14 days in jail after pleading guilty to two counts of failing to comply with the conditions of his undertaking. Theft Beckard Kleamyck has been ordered to serve 14 days in jail after pleading guilty to two counts of theft of property over $5,000 in value. Clarification The October 3 report of impaired driving and possession of stolen property convictions against Kelvin Ivan Quirion were from July 1995 charges. These are not new charges and should not have appeared in the court report and the Free Press apologizes for any inconvenience. Police seek hit and run witnesses Police are looking for any information that may help them solve a hit and run on the weekend. Around 1:15 Saturday morning, a 19-year-old man was trying to cross Highway 97 at 22nd Street when he was struck down by a northbound car. The young man has been taken to Prince George Regional Hospital where he remains in critical condition, suffering from multiple fractures and head injuries. Police continue to investigate the accident, and are asking anyone with information to contact the local detachment office or Crimestoppers. Announcing... John F.
