A16 THE FREE PRESS REGIONAL DECEMBER 21, 2000 Quesnel Manslaughter trial in the spring A 24-year-old former Quesnel man charged with a four-year-old manslaughter will put the Crown to the test next spring. On December 12, 1996, Mounties were called to the Bridge Motel in West Quesnel, where they found Kelly William Paul, 37, lying on the street in front of the motel. He was unconscious. He was rushed to G.R. Baker Memorial Hospital where he died later the same day, having never gained consciousness. An autopsy revealed Mr. Paul had suffered severe head injuries and exposure. But it was not until this past fall that anyone, namely Charles John Gut-friend, was charged. Mr. Gutfriend was arrested in Penticton and made a brief court appearance here on November 24, charged with manslaughter. Mr. Gutfriend is living with family in Naramata near Penticton. His lawyer made an appearance in Provincial Court in Quesnel on Tuesday, choosing a trial by judge and jury on behalf of his client. Mr. Gutfriend will have a preliminary hearing in B.C. Supreme Court, which will take place in Quesnel from May 7 to 11. Dennis Tylee went to tri-alin B.C. Supreme Court this month on 12 charges, including attempted murder and criminal negligence causing bodily harm. He was arrested on November 1st, 1998 after police were called to Unit 13 at the reserve. That was the location of a post-Halloween party with a number of people in attendance. He fired several shots outside the house, including one through the kitchen window. He then went into the house. One person in the house was shot through the forearm. Mr. Tylee was convicted of possessing a firearm for a dangerous purpose, break and enter and committing an assault and discharging a firearm at a person with the intent to cause harm. Defence counsel, however, is wondering at the Crown’s intent, suggesting there is little chance the Crown will be able to establish a pattern of behaviour. Mr. Tylee will go back before Justice Ian Meiklem on January 8. Operators of the Bullmoose coal mine were charged in April, under both the Waste Management Act and the Federal Fisheries Act, following an investigation in a coal mining waste spill on March 10, 1999, at South Bullmoose Creek. The operation is facing charges of introducing waste into the environment and failing to comply with the requirements of their waste management permit.
