August last, when Frost tendered Prestlien an acknowledgment on Giscome Spruce Mills stationery and u cheque drawn on the same concern. The cheque was returned on account of no funds. The defendant claimed the ac knowledgment should have been made out in the name of A. C. FrO9t Inc., the mistake being on the part of the clerk, and that Frost, being president of both companies, did not notice the error. They also claimed that payments on orders had been made. Judge Cahler gave a verdict with costs in favor of the plaintiff for tho full amount, the registrar to be referee as to whether orders had been paid before or subsequent to the settlement. P. E. Wileon appeared for trie plaintiff and W. O. Fulton, of Prince Rupert, for the defence. The regular meeting of the G. W. ?.
